Terms of Service

By creating an account or using 文人天下 (“the platform”, “we”, “us”), you agree to these Terms of Service. Please read them carefully before registering.

1. Eligibility

You must be at least 18 years of age to create an account. By registering, you confirm that you are 18 or older and that the information you provide is accurate and complete. We reserve the right to close accounts where we have reason to believe the user is under 18.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at rightspot.net@gmail.com if you suspect unauthorised access.

3. Subscription

Access to the platform’s full content requires a paid membership subscription.

  • Price: AUD $13 per month.
  • Free trial: New subscribers receive a 7-day free trial. No charge is made during the trial period.
  • Auto-renewal: After the trial, your subscription renews automatically each month until you cancel.
  • Cancellation: You may cancel at any time from your profile › Membership page. Access continues until the end of the paid billing period; no further charges are made after cancellation.
  • Payment processing: Payments are processed securely by Stripe. We do not store your card details.

4. Refunds

Nothing in these terms limits any rights you have under applicable consumer protection law, including the Australian Consumer Law (ACL).

Because the subscription service is digital and delivered continuously, we do not generally offer refunds for the current billing period once it has commenced. However, if you cancel your subscription, you will not be charged for any future billing period.

If you believe you are entitled to a refund under applicable law (for example, due to a failure to deliver the service as described), please contact us at rightspot.net@gmail.com. We will consider each request on its merits and comply with our legal obligations.

5. Acceptable Use

You agree not to:

  • Use the platform for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the platform or its systems
  • Scrape, copy, or redistribute content without our prior written consent
  • Interfere with the operation of the platform, its servers, or its infrastructure
  • Impersonate another person or entity
  • Use the platform if you are under 18 years of age

Breach of these terms may result in immediate account suspension or closure without refund.

6. Intellectual Property

All content on the platform — including characters, conversations, news articles, games, and software — is owned by or licensed to 文人天下. Your subscription grants you a personal, non-transferable, non-exclusive licence to access and use the content for your own private, non-commercial learning purposes only.

No content may be reproduced, distributed, published, or used commercially without our prior written consent. Downloading your personal data under the GDPR portability right does not grant any rights to platform content.

7. Newsletter & Communications

We send transactional emails (account events, subscription notices) to all account holders. We send marketing emails only to users who have given explicit consent. You may withdraw marketing consent at any time via the unsubscribe link in any email or from your profile settings.

8. Account Closure & Data Deletion

You may close your account at any time from your profile › Membership page. Closing your account cancels your subscription (effective end of current billing period) and places your account data in a 90-day soft-deletion period. You may reactivate within this window. After 90 days, all personal data is permanently and irreversibly deleted. A confirmation email is sent on the day of permanent deletion.

9. Disclaimer of Warranties

The platform is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the platform will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant that learning outcomes will meet your expectations.

Nothing in this clause excludes any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.

10. Limitation of Liability

To the fullest extent permitted by applicable law, 文人天下 and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, even if advised of the possibility of such damages.

Where liability cannot be excluded by law (including under the ACL), our liability is limited, at our option, to re-supplying the service or refunding the cost of the affected subscription period.

11. Indemnification

You agree to indemnify and hold harmless the platform operator from and against any claims, damages, losses, or costs (including reasonable legal fees) arising from your violation of these terms or your misuse of the platform.

12. Service Changes

We reserve the right to modify, suspend, or discontinue any part of the platform at any time. Where we make a material change that reduces the value of your paid subscription, we will notify you in advance and you may cancel for a pro-rata refund of unused subscription time. We will provide reasonable notice before discontinuing the platform entirely.

13. Dispute Resolution

We encourage you to contact us directly to resolve any dispute before pursuing formal action. If a dispute cannot be resolved informally, it will be subject to the jurisdiction of the courts of New South Wales, Australia, unless mandatory consumer protection laws in your country require otherwise.

14. Governing Law

These terms are governed by the laws of New South Wales, Australia. Nothing in these terms affects any non-excludable rights you have under the laws of your country of residence.

15. Changes to These Terms

We may update these terms from time to time. We will notify registered members by email of any material changes at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms. If you do not agree to a material change, you may close your account before the effective date.
